Introduction

These Terms and Conditions ("Terms") govern your use of the Lusit mobile application and related services. Lusit is a general wellness app for tracking movement and nutrition habits.

1. Acceptance of Terms

By creating an account or using Lusit, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the service. Acceptance of both is required at sign-up and recorded with the Privacy Policy version you accepted.

2. Service Description

Lusit lets you:

• Create and follow personalized activity plans
• Track daily movement and nutrition habits
• Receive personalized recommendations from your preferences and feedback
• View progress, streaks, and statistics
• Receive optional push notifications and reminders

Lusit is a wellness and lifestyle app, not a medical device, and does not provide medical advice, diagnosis, or treatment. Consult a qualified healthcare professional before starting any new exercise or nutrition program, especially with pre-existing health conditions.

3. Wellness Disclaimer

Lusit provides general wellness information and personalized activity suggestions based on your self-reported preferences. It is not a medical device and makes no medical claims. Its activities and suggestions are not a substitute for professional medical advice.

All movement and nutrition recommendations are based on the preferences and feedback you provide, not on clinical assessment. Discomfort or pain feedback you submit is treated as preference data used to adjust your plan, not as medical data.

If you experience pain or injury, or have an existing health concern, consult a qualified healthcare professional before continuing. Use of Lusit is at your own risk. Listen to your body and move within your comfort level.

4. Account Registration

To use Lusit you must:

• Be at least 18 (verified at sign-up via date of birth)
• Provide a valid email address
• Create a secure password
• Accept these Terms and our Privacy Policy

A confirmation email may be sent; some features may require email verification.

You are responsible for the confidentiality of your credentials and all activity under your account. Notify us at support@lusit.app if you suspect unauthorized access.

5. User Responsibilities

You agree to:

• Use Lusit only for its intended wellness purpose
• Provide accurate information about yourself
• Not disrupt, reverse-engineer, scrape, or interfere with the app or its servers
• Not use the app for any unlawful purpose
• Not impersonate others or share your credentials

6. Your Data Rights

You retain ownership of the personal data you provide. At any time you can:

Export: download your user-scoped data as JSON from Settings → Edit Profile → Export Data.

Delete: remove only your personal-profile and weight-history data, or your entire account and all associated data, from Settings → Edit Profile.

Account deletion is permanent and irreversible, with no grace period or recovery. See our Privacy Policy for full details on data handling, retention, and your GDPR rights.

7. Intellectual Property

All intellectual property in the Lusit app (design, code, UI, copy, illustrations, exercise content, video assets, learning materials) is owned by or licensed to Lusit. You receive a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes.

You may not copy, redistribute, modify, or create derivative works from the app or its content without our prior written permission.

8. Disclaimers & Limitation of Liability

Lusit is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement.

We do not guarantee:

• the accuracy of activity tracking, statistics, or computed metrics
• specific health, fitness, weight, or wellness outcomes
• uninterrupted, secure, or error-free service
• correction of defects

To the maximum extent permitted by law, Lusit is not liable for indirect, incidental, consequential, special, or punitive damages arising from your use of, or inability to use, the app, including injury from activities performed following its suggestions. Mandatory consumer-protection law (in particular German and EU law) remains unaffected.

9. Termination & Suspension

You may stop using Lusit and delete your account at any time, free of charge.

We may suspend or terminate your account, with or without notice, if you violate these Terms, disrupt the service, or act abusively or fraudulently. On termination by us, you may request data export within 30 days of the termination notice (except in cases of severe abuse).

10. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules. The UN Convention on Contracts for the International Sale of Goods does not apply.

Disputes are subject to the jurisdiction of the courts in Germany. Mandatory consumer-protection laws of your country of residence remain unaffected where applicable.

11. Changes to These Terms

We may update these Terms. Changes are reflected by updating the effective date above. We notify you in-app of material changes. Continued use after a material change becomes effective constitutes acceptance.
